LEGALIZATION  OF COMMERCIAL DOCUMENTS

As  per  AFIP  Instruction  88/99  all  products  manufactured  in  countries  non-members  of  the  World Trade  Organization  (WTO)  -People’s  Republic  of  China or others-,  must  be  accompanied  by  a  legalized Certificate  of  Origin (C.O.) when  exported  to  Argentina.  The  legalization  procedures  are  the  following :     

1.      Products manufactured in countries non-members of the WTO (eg. People’s Republic of
      China) and shipped to Argentina directly from the country of origin or transshipped via 

     Hong Kong:

 The original C.O. must be legalised by the Argentine Consular Office in the country of origin (in this case, the consignee in the C.O. must be an Argentine company).

 

2.      Products manufactured in countries non-members of the WTO (e.g. People’s Republic of 
      China)
and re-exported to Argentina from Hong Kong SAR or Macao SAR :  

A copy of the C.O. issued by a non-WTO member country (e.g. PRC) must be endorsed with a “seen” chop by the Argentine Consulate General in Hong Kong (in this case, the consignee in the C.O. must be a Hong Kong or Macau company) and the procedure for this legalization is the following : 

    i.        On the back of a copy, duplicate, triplicate or photocopy of the C.O. issued by a non-WTO member country (e.g. PRC), the exporter must write the following exact declaration (in both Spanish and English) :

 

Declaro bajo juramento que los siguientes datos son correctos
(I declare under oath that the following information is true and correct)
 

* Importador en la República Argentina (Importer in the Argentine Republic) : 

* Fecha y número de la factura por la cual el exportador compró la mercadería al fabricante en el país de origen (Date and number of the invoice by which the exporter  purchased the goods from the
manufacturer  in the country of origin) :

* Parte del embarque que es reexportado a la Argentina (Portion –quantity- of the shipment that is re-exported to Argentina) : 

* La factura comercial que acompaña a la Solicitud de Destinación indica el número de Certificado de
Origen (The commercial invoice presented for Customs clearance of imported goods indicates the number of Certificate of Origin)

           ii.         One double-face photocopy (front and back) of the C.O. with the above mentioned
           declaration.

   iii.       One duplicate (no photocopy) of the Commercial Invoice issued by the Hong Kong  or
          Macau exporter to Argentina.  

3.      Products in some chapters of the Harmonized System –whose origin must be accredited for statistical purposes as per Res. MEYOSP 763/96, art.2, item c)–, require that the original Certificate of Origin be legalized by the Argentine Consulate in the country of origin. Further details and clarification on this particular matter, must be obtained through your agent or importer in Argentina.

However, if the products refered to in this point are re-exported from Hong Kong, this Consulate General will only authenticate a copy of the commercial invoice issued in the country of origin  (PLEASE REFER TO POINT N° 4). 

4.       Copy of factory invoice from country of origin (outside Hong Kong / Macau), require :

a)       Original Invoice issued in the Country of Origin and two photocopies (invoice date and number should match the same data stated in the Certificate of Origin). 

b)       Original and one photocopy of the Certificate of Origin (as issued in country of origin) already endorsed by the Argentine Embassy with jurisdiction in the country of origin.

The original C.O. and invoice will be returned to the applicant.

 

5.       Packing List, Price List and Certificate of Origin issued in Hong Kong / Macau (ONLY for products manufactured in Hong Kong or Macau), require : 

a)       Original and one duplicate (no photocopy), both duly endorsed by any chamber of commerce registered in Hong Kong / Macau. 

b)       Certificates of Origin MUST clearly state the number of  the corresponding invoice 

The Certificate of Origin (Processing) issued in Hong Kong or Macau should follow same procedure as a) and b), but it MUST state that the goods have been modified, altered, assembled or packed  in Hong Kong or Macau.

 

6.       Commercial  Invoice (issued in Hong Kong / Macau), require : 

a)       Original Invoice and two duplicates (no photocopies), all endorsed by any chamber of commerce registered in Hong Kong / Macau. 

b)       The following declaration in both SPANISH and ENGLISH must be typed at the end of the invoice:

“Declaro bajo juramento que la información contenida en esta factura es exacta y que el precio indicado es el único que realmente ha sido pagado (o a pagarse). También declaro que no existen convenios que permitan modificaciones de dichos precios.

I do hereby certify, that the information herein disclosed is accurate and that the price stated is the only one that has been really paid (or to be paid).  I also hereby declare that there are no agreements  that allow modifications to the said prices"

CERTIFICATE OF ORIGIN “RE-EXPORT” is NOT required by the Argentine Customs Department and will not be endorsed by this Consulate General    


THE PRESENT GUIDELINES AND INTERPRETATIONS OF THE CURRENT LAWS AND INSTRUCTIONS ON THIS MATTER, ARE FOR REFERENCE PURPOSE ONLY.

RECEPTION / COLLECTION OF DOCUMENTS: Monday to Friday,  10.00 a.m. to 12.00 p.m.

Processing time takes 2 working days after we collect the payment receipt.

PAYMENT: It can be made by cash or cheque (to the order of the “Argentina Consulate General”) and requires applicant to make a deposit at Citibank using only the payment voucher issued by this Consulate General.
